Terms of Service

These Terms of Service explain the rules for using the FarmerMarket mobile application on Android and iOS, as well as related FarmerMarket website features. They are designed to clearly explain what FarmerMarket provides, what users are responsible for, and what limits apply while the service continues to evolve in beta.

1. Operator of the service

FarmerMarket is operated by FarmerMarket sp. z o.o., ul. Aleje Jerozolimskie 109, 02-001 Warszawa, Poland.

2. Acceptance of the Terms and eligibility

By accessing or using FarmerMarket, you agree to these Terms of Service. If you do not agree with these Terms, you should not use the service.

FarmerMarket is intended for a general audience aged 16 and older. If you use the service on behalf of a business or farm, you confirm that you are authorized to act for that entity.

3. What FarmerMarket provides

FarmerMarket is a platform that helps customers discover local farmers and helps farmers present their farms and products. FarmerMarket may include mobile app features, website features, account features, and contact tools related to this service.

FarmerMarket is currently in beta. This means features, availability, user flows, and access rules, including anonymous access, may change, be limited, or be removed as the service develops.

4. Accounts and access

Some parts of FarmerMarket may be available without full registration during beta, but many features require an account. When you create or use an account, you are responsible for keeping your login credentials secure and for activities that take place through your account.

  • FarmerMarket currently supports sign-in by email and password, Sign in with Apple, Google Sign-In, and Facebook Sign-In.
  • You should provide accurate account information and promptly update it if it changes.
  • One account may be used as both a customer and a seller, depending on available product features.
  • Anonymous or limited browsing may be available during beta, but the scope of that access is not guaranteed and may change at any time.

5. User content and ownership

You may upload or submit content through FarmerMarket, including listings, product photos, farm photos, descriptions, profile information, and, if enabled, ratings or reviews. You remain responsible for the content you submit.

  • You represent that you own the content you upload or have the necessary rights to use and share it.
  • You grant FarmerMarket a non-exclusive right to host, display, reproduce, and process your content as needed to operate, improve, and promote the service.
  • You must ensure that your content is accurate, lawful, and not misleading.
  • If ratings or reviews are enabled, they must reflect genuine experience and must not be false, abusive, or manipulative.

6. Seller obligations

If you use FarmerMarket as a seller or farmer, you are responsible for how your farm, products, and pickup arrangements are presented and handled.

  • You may only list products that may lawfully be offered, promoted, and transferred under applicable law.
  • Your listings, descriptions, product photos, and profile information must be accurate and not misleading.
  • You must provide clear and reasonably accurate information about pickup locations, availability, and contact details where applicable.
  • You are responsible for complying with food, agricultural, consumer, and other legal requirements that apply to your activity.

7. Customer obligations

If you use FarmerMarket as a customer, you must use the service lawfully and respectfully.

  • You may not use the service for fraudulent, unlawful, or abusive purposes.
  • You must communicate respectfully with sellers and other users and must not harass, threaten, or impersonate others.
  • You are responsible for making your own decision about whether to contact a seller, arrange pickup, or proceed with a transaction outside the app.

8. Prohibited conduct and listings

You may not use FarmerMarket to upload, publish, request, or facilitate content or activity that is unlawful, unsafe, misleading, or harmful to the platform or its users.

  • Illegal products, unlawful services, or content that violates applicable law are prohibited.
  • False, deceptive, or materially misleading listings or profile information are prohibited.
  • Content that infringes intellectual property, privacy, or other rights of third parties is prohibited.
  • Attempts to interfere with the operation, security, or integrity of FarmerMarket are prohibited.
  • Listings for unsafe, prohibited, or improperly described food or agricultural products are prohibited.

9. Transactions, pickup, and payments

FarmerMarket is only a platform that connects customers and sellers. FarmerMarket is not the seller, reseller, merchant of record, delivery provider, or payment processor for transactions arranged through the service.

Any agreement relating to product availability, quality, quantity, pricing, pickup, payment, or related issues is made directly between the customer and the seller.

  • FarmerMarket is not a party to the sale or pickup arrangement between users.
  • FarmerMarket does not guarantee the quality, legality, safety, availability, accuracy, or successful completion of any listing, pickup, or transaction.
  • FarmerMarket does not currently process payments inside the app. Payments, if any, are arranged directly between users outside the app.

10. External services and third-party tools

Some features of FarmerMarket may interact with third-party services or tools. Your use of those third-party services may also be subject to their own terms and policies.

  • Contacting a seller may redirect you to an external messaging or device communication app.
  • Sign-in through Apple, Google, or Facebook is subject to those providers’ terms and technical requirements.
  • Location and map-related functionality may depend on third-party mapping or geolocation services.

11. Suspension, removal, and termination

FarmerMarket may suspend, limit, or terminate access to the service, or remove content, if we reasonably believe it is necessary to protect the platform, comply with law, or address misuse.

  • We may suspend or terminate accounts involved in repeated violations, fraud, abuse, unlawful conduct, or security risks.
  • We may remove listings, photos, descriptions, reviews, or other content that violate these Terms or applicable law.
  • We may take action where content or behavior creates legal, operational, reputational, or safety risk for FarmerMarket or its users.

12. Disclaimers and limitation of liability

FarmerMarket is provided on an "as is" and "as available" basis to the extent permitted by law. Because the service is in beta, we do not promise uninterrupted availability, error-free operation, or that all features will remain unchanged or continuously available.

To the extent permitted by law, FarmerMarket is not liable for losses arising from dealings, communications, pickups, or transactions between users, or from third-party services, listings, content, or temporary service interruptions. Nothing in these Terms excludes liability that cannot lawfully be excluded under applicable law.

13. Fees and future paid features

FarmerMarket does not commit in these Terms to any specific pricing, commission, or paid feature model at this stage. If we introduce paid features, subscription options, commissions, or similar commercial terms in the future, we will describe them separately or update these Terms accordingly.

14. Governing law and disputes

These Terms are governed by the laws of Poland, unless mandatory consumer protection laws provide otherwise.

Nothing in these Terms limits rights that you may have under mandatory applicable consumer law. Before escalating a dispute, we encourage users to contact FarmerMarket through the contact page so we can try to resolve the issue.

15. Changes to these Terms

We may update these Terms of Service from time to time to reflect legal, operational, or product changes. When we do, we will publish the updated version on this page and update the effective date shown above.
